These Terms & Conditions (“Terms”, “Terms and Conditions”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and KidsKosmos (“KidsKosmos”, “we”, “us”, or “our”) governing your access to and use of the KidsKosmos website, mobile applications, software, platforms, products, features, content, and services (collectively, the “Services”).

These Terms apply to all users of KidsKosmos, including parents, legal guardians, children where permitted, therapists, doctors, specialists, educators, experts, clinics, schools, organizations, and other authorized users.

By accessing, registering for, or using KidsKosmos, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not access or use the Services.

1. ABOUT KIDSKOSMOS

KidsKosmos is a technology-enabled child-development platform designed to support children, parents, guardians, therapists, specialists, educators, and other authorized professionals.

Depending on the features available to you, KidsKosmos may provide:

Emotional and behavioral support

Appointments
Personalized development plans

Developmental milestones
Reports and assessments
Therapist notes

Home-practice activities
Notifications and reminders
Expert profiles
Professional services
Organization, school, clinic, or institutional services
Other related child-development services

The Services and features available to each User may vary depending on account type, location, professional availability, organization, subscription, plan, or other applicable conditions.

2. DEFINITIONS

For purposes of these Terms:

“App”

means the KidsKosmos mobile application made available through Apple App Store, Google Play Store, or other authorized platforms.

“Child”

means a minor whose information is entered, managed, or processed through KidsKosmos.

“Parent/Guardian”

means a parent, legal guardian, or other person legally authorized to act on behalf of a Child.

“Professional”

means a therapist, specialist, educator, doctor, counselor, expert, or other professional who provides or supports services through KidsKosmos.

“User Content”

means information, photographs, videos, documents, messages, assessments, notes, reviews, feedback, or other material submitted by a User.

“Services”

means all KidsKosmos websites, applications, software, features, content, products, and related services.

3. ELIGIBILITY

You may use KidsKosmos only if you are legally permitted to enter into these Terms.

Where a Child’s information is entered into KidsKosmos, the person creating or managing the Child’s profile must have appropriate legal authority to do so.

A Parent or Guardian may create and manage an account for a Child where permitted by applicable law.

Professionals and organizations must use KidsKosmos only in connection with their legitimate professional or organizational activities.

You must not create an account using false, misleading, stolen, or unauthorized information.

4. PARENT AND GUARDIAN RESPONSIBILITIES

Parents and legal guardians are responsible for ensuring that:

Information provided about the Child is accurate.
They have the legal authority to provide the Child’s information.
Appropriate consent is obtained where required.
Account credentials are kept confidential.
Access to the Child’s information is provided only to authorized persons.
They review relevant information provided through the Services.
They use the Services in accordance with applicable laws.
They immediately notify KidsKosmos of suspected unauthorized access.

Parents and guardians are responsible for decisions concerning their Child’s care, treatment, education, and wellbeing unless otherwise agreed with an appropriately qualified professional.

5. PROFESSIONAL ACCOUNTS

Professionals using KidsKosmos are responsible for ensuring that:

Their registration information is accurate.
Their professional credentials are accurate and current.
They maintain all legally required licenses, registrations, certifications, and qualifications.
They provide services within the scope of their professional qualifications.
Information entered into the platform is accurate to the best of their knowledge.
They maintain appropriate confidentiality.
They access only information they are authorized to access.
They comply with applicable professional and legal requirements.

KidsKosmos may request verification of professional information.

KidsKosmos reserves the right to suspend or remove professional accounts where information is inaccurate, misleading, fraudulent, expired, or otherwise inconsistent with applicable requirements.

6. ACCOUNT REGISTRATION

Certain features require registration.

When creating an account, you agree to provide:

Complete information where requested
Current contact details
Accurate identification information where required
Accurate professional or organization information where applicable

You must update your information if it becomes inaccurate or outdated.

You must not create multiple accounts for fraudulent, abusive, or deceptive purposes.

7. ACCOUNT SECURITY

You are responsible for maintaining the security of your account.

You must:

Log out from shared devices where appropriate.

KidsKosmos will not ask you to provide your password through an unsolicited email or message.

8. ACCOUNT DELETION

You may request deletion of your KidsKosmos account in accordance with our account deletion process.

Account deletion may result in permanent loss of:

Child information
Therapy records
Assessment records
Progress records
Documents
Appointments
Messages
Other account-associated information

Deletion is subject to our Privacy Policy and applicable legal retention requirements.

Certain information may be retained where necessary for:

Legal compliance
Fraud prevention
Security
Accounting
Tax requirements
Dispute resolution
Establishing or defending legal claims
Other legally permitted purposes

Deleting the application from your device does not automatically delete your KidsKosmos account.

9. CHILDREN’S INFORMATION

KidsKosmos may process information relating to children.

Parents, guardians, professionals, and organizations must only submit Child information when they have appropriate authorization.

Users must not:

Create unauthorized Child profiles.
Access another Child’s information without authorization.
Share Child information without appropriate authority.
Use Child information for unlawful purposes.
Attempt to identify or contact children outside the intended service.

10. CHILD SAFETY

KidsKosmos has zero tolerance for child exploitation, abuse, grooming, harassment, or inappropriate use of the platform.

Users must not use KidsKosmos to:

Exploit a Child.
Abuse a Child.
Groom a Child.
Harass a Child.
Threaten a Child.
Sexualize a Child.
Share sexually explicit material involving a Child.
Attempt unauthorized contact with a Child.
Facilitate harmful activities involving a Child.
Request inappropriate photographs, videos, or information from a Child.
Use the platform for any unlawful activity involving a Child.

KidsKosmos may immediately suspend or terminate accounts involved in suspected violations and may report matters to appropriate authorities where required or appropriate.

11. THERAPY AND PROFESSIONAL SERVICES

KidsKosmos may facilitate access to developmental, educational, therapeutic, or professional services.

Services may be provided by independent professionals, therapists, specialists, clinics, schools, organizations, or other service providers.

Unless expressly stated otherwise, KidsKosmos does not guarantee:

A particular diagnosis.
A particular treatment outcome.
A particular developmental outcome.
A specific improvement within a specific period.
The availability of a particular Professional.
The suitability of a particular therapy for every Child.
Any specific medical, developmental, educational, behavioral, or therapeutic result.

Professional services remain subject to the professional judgment of the relevant qualified Professional.

12. MEDICAL AND DEVELOPMENTAL DISCLAIMER

KidsKosmos may provide developmental, educational, therapeutic, informational, or general wellness information.

Such information is not intended to replace professional medical, psychological, developmental, educational, or therapeutic advice.

You should consult an appropriately qualified Professional when professional evaluation, diagnosis, treatment, or intervention is required.

KidsKosmos is not an emergency medical service.

In an emergency, contact the appropriate emergency services, hospital, doctor, or other emergency healthcare provider.

13. ASSESSMENTS

KidsKosmos may provide or facilitate developmental assessments, questionnaires, screening tools, evaluations, or other assessment-related features.

Unless explicitly stated otherwise, an assessment or screening result:

Is not necessarily a medical diagnosis.
Does not replace professional evaluation.
May contain limitations.
Should be interpreted appropriately by qualified Professionals where required.

Users should not make significant medical, educational, therapeutic, or developmental decisions solely on the basis of automated or informational results.

14. ARTIFICIAL INTELLIGENCE AND AUTOMATED FEATURES

KidsKosmos may use artificial intelligence, machine learning, automation, or algorithmic technologies for certain features.

These technologies may support:

Other platform functionality

AI-generated or automated information may contain errors or inaccuracies.

KidsKosmos may modify or discontinue AI-powered features at any time.

15. APPOINTMENTS

Where appointment functionality is available:

Professionals may become unavailable.
Appointments may be cancelled or rescheduled.
Users are responsible for attending scheduled appointments.
Users should provide accurate contact information.

KidsKosmos is not responsible for missed appointments caused by inaccurate information, device problems, network failures, or circumstances outside our reasonable control.

16. CANCELLATIONS

Where cancellation rules apply, they will be communicated before or during the applicable transaction where reasonably possible.

Repeated cancellation, no-show, or abusive behavior may result in account restrictions.

Subscriptions purchased through Apple or Google may be managed according to the applicable platform’s subscription system and rules.

Deleting the KidsKosmos application does not necessarily cancel an active subscription.

Users must cancel subscriptions through the appropriate platform or payment provider where applicable.

19. REFUNDS

Where Apple or Google processed the transaction, refund requests may need to be submitted through the applicable platform.

Nothing in these Terms limits any mandatory refund or consumer rights available under applicable law.

You are responsible for ensuring that you have the appropriate rights and authorization to submit such content.

You must not upload content that:

Is unlawful.
Infringes intellectual-property rights.
Violates another person’s privacy.
Contains malware.
Is fraudulent or misleading.
Is abusive or threatening.
Is sexually explicit or inappropriate.
Exploits or harms children.

22. LICENSE TO USER CONTENT

By submitting User Content, you grant KidsKosmos a limited, non-exclusive, royalty-free license to process and use that content solely as reasonably necessary to:

KidsKosmos does not obtain ownership of your User Content merely because you submit it.

25. LIMITED LICENSE TO USE THE APP

Subject to these Terms, KidsKosmos grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the application for its intended purposes.

Distribute the application.
Sell or sublicense the application.
Reverse engineer the application except where legally permitted.

KidsKosmos does not control the professional judgment of independent Professionals.

A Professional’s opinions, recommendations, assessments, treatment plans, or services are their responsibility.

Users should independently evaluate whether a Professional is suitable for their needs.

38. NO GUARANTEE OF OUTCOMES

KidsKosmos does not guarantee any particular:

Developmental improvement.
Therapy outcome.
Educational result.
Behavioral change.
Medical outcome.
Assessment result.
Treatment result.

Outcomes may vary significantly between individuals.

39. EMERGENCY SERVICES

KidsKosmos is not an emergency-response service.

Do not use KidsKosmos as a replacement for emergency medical or child-protection services.

If a Child or another person is in immediate danger, contact the appropriate emergency service, hospital, police, child-protection authority, or qualified professional.

40. ACCOUNT SUSPENSION

KidsKosmos may suspend an account if we reasonably believe that:

These Terms have been violated.
The account is being used fraudulently.
Unauthorized access is suspected.
The account presents a security risk.
The User has submitted unlawful content.
Child safety may be at risk.
Continued access may harm another User.
Suspension is required by law.

Where appropriate and legally permitted, we may provide an opportunity to resolve the issue.

41. ACCOUNT TERMINATION

You may stop using KidsKosmos at any time.

KidsKosmos may terminate or restrict access where permitted by applicable law.

Termination may result in loss of access to:

Appointments.
Messages.
Services.
Other platform features.

Termination does not automatically eliminate obligations that arose before termination.

42. EFFECT OF TERMINATION

Particular therapeutic or developmental results will occur.
Third-party services will always be available.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

44. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, KidsKosmos and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or relating to your use of the Services.

Service interruption.
Device problems.
Third-party service failures.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

53. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any additional terms applicable to specific Services, constitute the agreement between you and KidsKosmos regarding your use of the Services.

Additional service-specific terms may apply where clearly communicated.

54. GOVERNING LAW

These Terms shall be governed by the applicable laws of India, subject to mandatory rights and protections available to Users under applicable law.

Nothing in these Terms is intended to remove or restrict any mandatory consumer or statutory rights that cannot legally be waived.

55. DISPUTE RESOLUTION

If you have a complaint or dispute, we encourage you to contact KidsKosmos first so that we can attempt to resolve the matter informally.

58. APP STORE TERMS

If you download or use the KidsKosmos application through the Apple App Store or Google Play Store, additional terms imposed by the relevant platform may apply.

Your use of the application must also comply with the applicable platform’s rules and policies.

Apple and Google are not parties to these Terms except where their applicable platform terms provide otherwise.

KidsKosmos, not Apple or Google, is responsible for the KidsKosmos application and its content and services, except for matters that are the responsibility of the applicable platform under its own terms.

59. APPLE APP STORE ACKNOWLEDGEMENT

If you obtain the KidsKosmos application through Apple’s App Store, you acknowledge that these Terms are between you and KidsKosmos and not Apple.

To the extent required by Apple’s applicable terms:

Apple has no obligation to provide maintenance or support for the application.
Apple is not responsible for addressing claims relating to the application.
Apple is not responsible for investigating or defending third-party intellectual-property claims relating to the application.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions as permitted by Apple’s terms.

60. GOOGLE PLAY ACKNOWLEDGEMENT

If you obtain the KidsKosmos application through Google Play, your use of the application is also subject to applicable Google Play terms and policies.
